(Policy Interpretation) Policy Interpretation of "Implementation Opinions on Ensuring National Treatment for Foreigners to Establish Enterprises with Permanent Resident ID Card"

Based on the pilot program implemented by Beijing Municipality to ensure national treatment for foreigners in setting up science and technology enterprises with permanent resident ID cards, this policy is released to steadily expand the applicability of the pilot, to secure foreigners' entitlement to national treatment by law in more aspects when establishing enterprises in more domains and in more areas in Beijing with their permanent resident ID cards.

In addition to special national and municipal measures and regulations on market access, the policy supports the use by foreigners of permanent resident ID cards to set up businesses in key areas such as scientific and technological services, digital economy and trade development, financial services, Internet information services, business, cultural and tourism services, health and medical services, and professional services.

The policy also supports foreigners to use their permanent resident ID cards to set up businesses in China (Beijing) Pilot Free Trade Zone, China (Hebei) Pilot Free Trade Zone Daxing Airport Area, Zhongguancun National Innovation Demonstration Zone, Tianzhu Comprehensive Bonded Zone, Sino-German International Cooperation Industrial Park, and Sino-Japanese Industrial Park and legally entitles them to receive national treatment.

The pre-access national treatment and negative list management system for enterprises receiving foreign investment will be applied for foreigners using permanent resident ID cards to set up businesses. In accordance with the principle of voluntary application, they can apply for the establishment of limited liability companies, joint-stock companies (excluding listed companies), and partnerships.

When setting up a business, foreigners providing a permanent resident ID card as proof of identity will not be required to provide additional notarization or certification.

This policy came into effect on the date of issuance of the "Implementation Opinions" (July 30, 2021). In the event of any inconsistency between the previous "Notice on the Trial Measures for Foreign Talents Holding Permanent Resident ID Cards to Start High-tech Enterprises" (Jing Ke Fa [2020] No. 6) jointly issued by Beijing Municipal Science & Technology Commission, Beijing Municipal Human Resources and Social Security Bureau, Beijing Municipal Administration for Market Regulation, Administrative Committee of Zhongguancun Science Park, Management Committee of Tianzhu Comprehensive Bonded Zone , and Daxing District People's Government of Beijing Municipality and the provisions of the "Implementation Opinions", the provisions of the latter shall prevail.
